Version: 2.0 Effective Date: October 20, 2026
This Agreement is between In Flow LLC, a California limited liability company doing business as CardPlan (“CardPlan,” “we,” “us”), and the person or entity that joins the CardPlan affiliate program (“Affiliate,” “you”). It governs your participation in the CardPlan Affiliate & Creator Program (the “Program”).
By checking the agreement box when you apply, or by otherwise affirmatively accepting this Agreement in a way we make available, you agree to be bound by it. If you accept for a business, you confirm you can bind it. If you do not agree, do not participate.
1. Joining the Program
1.1 Approval. We may approve, reject, suspend, or end any application or account at our discretion, for lawful business, compliance, fraud-prevention, or reputation reasons. Applying or receiving a link does not guarantee approval, commissions, or continued participation.
1.2 Eligibility. You must be at least 18, able to form a contract, and not barred from receiving payments under U.S. sanctions or other law. You must give accurate identity, contact, channel, payout, and tax information and keep it current. Participation from outside the United States requires our written approval. We may ask you to verify your identity or that you control the channels you promote on.
1.3 Non-exclusive; no guarantees. The Program is non-exclusive. We do not guarantee traffic, sales, earnings, tracking accuracy, or that any product, offer, or the Program will remain available.
1.4 Independent business. You are an independent party, not our employee, partner, franchisee, or agent. You cannot bind us or make commitments for us. You decide what to create, when, and how, subject to this Agreement and applicable law. We require no minimum content or hours. You are responsible for your own expenses and taxes. Nothing here limits any status or right that law gives you regardless of this label. (Commissioned content is separate; see the Creator Content Addendum.)
2. Links and Attribution
2.1 Affiliate Links. We issue personalized links or codes through PromoteKit or another system we choose (“Affiliate Links”). A link or custom URL (for example, getcardplan.com/yourname) gives you no ownership of any CardPlan domain, name, or mark.
2.2 Attribution window. A purchase can be attributed to you only if it is completed within 60 days after a tracked click on your Affiliate Link, as recorded by our tracking system.
2.3 Which affiliate gets credit. If more than one affiliate could be credited, the referral our tracking system records at checkout controls. We may announce a different rule for a specific campaign before the referral occurs.
2.4 How purchases are tracked. Attribution works only for purchases completed through CardPlan’s official checkout after a tracked click. Purchases made another way, after a customer clears or blocks cookies, switches devices or browsers, or through a privacy tool may not be tracked. We do not guarantee uninterrupted or error-free tracking, and a dashboard entry or click is not itself an entitlement to a commission.
2.5 Attribution disputes. If you believe a purchase was misattributed or missed, send us the transaction details and any supporting evidence within 30 days after the purchase date or, if later, the date the issue could reasonably have become visible to you. We review timely disputes in good faith using our payment and tracking records and are not required to pay commissions we cannot reasonably verify.
3. Commissions
3.1 Standard commission. For the initial campaign, the commission is $25 USD for each Qualified Purchase of CardPlan’s one-time Connected Lifetime offer (the “Lifetime Offer,” currently priced at $99 plus applicable tax). Only one commission is payable per customer. Other products, plans, renewals, upgrades, and offers earn nothing unless we designate them commission-eligible in writing.
3.2 Qualified Purchase. A “Qualified Purchase” is a purchase that meets all of these conditions: (a) it is the customer’s first purchase of the Lifetime Offer. An existing free CardPlan user qualifies when buying the Lifetime Offer for the first time. A person or account that already holds the Lifetime Offer does not qualify; (b) payment is successfully received and verified through our payment processor; (c) the purchase is attributed to you under Section 2; (d) the purchase is not refunded, reversed, disputed and lost, duplicated, or otherwise invalid; and (e) you complied with this Agreement in generating it.
3.3 Not eligible. No commission is payable on: self-referrals, meaning your own purchases or those of entities you control; any purchase by a person or account that already holds the Lifetime Offer; purchases arranged mainly to earn or split a commission; test, stolen-card, or fraudulent transactions; duplicate purchases (including a second Lifetime purchase on an account that already has one, which we refund automatically); purchases generated by conduct prohibited in Section 6; or purchases refunded in full or reversed by chargeback. Purchases by friends, family, or colleagues are not excluded merely because of the relationship, but we may reject coordinated purchases designed to manipulate commissions.
3.4 Pending, approved, paid. A commission is pending when attributed. It becomes approved after a 30-day qualification period following our receipt of the customer’s payment, provided no refund, dispute, chargeback, fraud review, or compliance issue is unresolved. Approved commissions enter the next monthly payout cycle (Section 4.1). While a customer’s payment is subject to an open dispute, the related commission stays pending.
3.5 Refunds, disputes, and reversals. Customer sales are generally final except where law requires otherwise, as stated in CardPlan’s customer terms. This Agreement does not create or expand any customer’s refund rights. If a customer’s payment is refunded in full, charged back, or lost in a dispute, the related commission is cancelled. If that happens after we have paid you, we may offset the amount against future commissions and, if none are owed, request repayment. A partial refund does not reduce the commission unless we say so for a campaign in advance.
3.6 No other compensation. Unless agreed in writing, you receive no fee, bonus, recurring share, or reimbursement.
4. Payment
4.1 Timing. Commissions are reviewed for 30 days after the customer payment under Section 3.4. Once approved, they are included in the next available monthly payout batch. Under our current Net-30 campaign setting, commissions earned during a calendar month are generally due on or after the 30th day of the following month, but not before their qualification period ends. If the initial monthly batch falls before a commission is approved, that commission moves to the next monthly batch. Payout timing assumes your payout and tax information is complete and no hold under Section 4.4 applies.
4.2 Minimum. Payouts are made once approved commissions total $25 or more; smaller balances carry forward. When a relationship ends other than for fraud or material breach, we will pay any approved balance, including one below $25, if a valid payout method is on file and payment is lawful.
4.3 Method and information. We pay through a method we support. You must supply accurate payout details and the tax documentation we reasonably require (for example, a Form W-9 or W-8). We may withhold or delay payment until you do, or as required by law, sanctions screening, or our payment provider. You bear payment-provider fees we disclose in advance.
4.4 Holds. We may hold a specific commission if we have a reasonable, documented basis to suspect fraud, misattribution, reversal, or material non-compliance related to it. Where practical and lawful, we will tell you the general reason and give you a chance to respond. We will not withhold undisputed commissions merely because unrelated referrals are under review.
4.5 Earned commissions are protected. Approved commissions that are legitimately earned are not forfeited by later program changes, by ordinary termination, or because we change or end the Lifetime Offer. They may be cancelled or recovered only for the reasons in Section 3.5, fraud, or a material breach connected to the commission.
5. Advertising Rules
5.1 Compliance with law. You must comply with all laws and platform rules that apply to your promotion, including the FTC Act, the FTC’s Endorsement Guides (16 C.F.R. Part 255) and Rule on Consumer Reviews and Testimonials (16 C.F.R. Part 465), California advertising and unfair-competition law, CAN-SPAM, the Telephone Consumer Protection Act, and applicable privacy laws.
5.2 Disclose that you are paid. Whenever you promote CardPlan, clearly and conspicuously disclose that you earn a commission or have another material connection to CardPlan, in the content itself and in a place and manner viewers will notice (for video and audio, say or show it; do not rely only on a hashtag, profile bio, or hidden link). Platform paid-partnership tools are encouraged but do not replace a clear disclosure. Our Creator Compliance Guide has examples.
5.3 Be accurate. Everything you say about CardPlan must be truthful, current, substantiated, and not misleading, including through omission. Describe only features that are actually available. Correct or remove statements that are or become inaccurate.
5.4 Material qualifications. You do not have to repeat CardPlan’s full offer terms in every post. But if you describe the Lifetime Offer, price, or connected-card features, you must not leave out a qualification that a reasonable viewer would need to avoid being misled. In particular, you must not suggest that:
- “lifetime” means your lifetime or a guaranteed period (we define it in our Lifetime Deal Terms by reference to CardPlan Connected’s operational life, and the service may change or end);
- the Lifetime Offer includes future premium products, AI features, integrations, or unlimited usage;
- the offer or its price is permanent or limited in a way we have not confirmed; or
- connected-card use is unlimited or unconditional (the Lifetime Offer allows a limited number of simultaneous institution connections and has an inactivity rule).
A short statement such as “one-time $99 + tax; see terms” with a link to the current offer page satisfies this section for ordinary promotion, unless your content makes a claim the link cannot cure.
5.5 Prohibited claims. Without our prior written approval backed by substantiation, you must not state or imply that CardPlan or its use: (a) will raise, repair, or guarantee any credit score; (b) guarantees debt reduction, a payoff date, savings, interest-rate reductions, approvals, or any financial result; (c) provides credit repair, or personalized financial, legal, tax, or investment advice; (d) pays bills, negotiates with creditors, or moves your money, or prevents late fees, missed payments, or overdrafts; (e) offers features that are not currently available, including capabilities not available in the customer’s purchased plan (such as certain monitoring, history, recalculation, or reminders); (f) uses AI to advise, decide, or act for the customer, or is “AI-powered,” unless we have approved that specific wording; (g) is “bank-level,” “unhackable,” “100% secure,” or similarly absolute about security or privacy.
5.6 Financial education. You may share general financial education. You must not present yourself as a CardPlan advisor, counselor, or representative, or give individualized recommendations on our behalf.
5.7 AI and synthetic content. You may use AI tools for editing, captioning, translation, and ordinary production. You must not use AI or any other method to create or present: fake customers, fake reviews or testimonials, synthetic people presented as real users, fabricated results, balances, or screenshots, or the voice or likeness of any real person without permission. Any AI-generated presenter or scenario must not mislead viewers about a real experience, and you must disclose synthetic content where law or platform rules require it or where the audience would otherwise be misled. Screenshots must be real, current, and not altered to change meaning (you may blur personal data).
5.8 Testimonials and results. You may share only your own genuine experience, honestly described. Do not claim typical results, savings, or score changes unless we have approved and substantiated the claim.
5.9 Approval for higher-risk uses. You may publish compliant organic content without our pre-approval. We may require advance approval for paid advertising, claims about outcomes or security, new offers or discounts, and similar high-risk uses.
6. Prohibited Conduct
Without our prior written authorization, you must not: (a) bid on or buy ads for CardPlan trademarks, brand variants, misspellings, or confusingly similar terms, or run any paid promotion of CardPlan (search, social, retargeting, or paid amplification); (b) register or operate domains, handles, apps, profiles, or pages that imitate CardPlan or suggest official status, or present a page as CardPlan’s support or checkout page; (c) use cookie stuffing, forced clicks, deceptive redirects, toolbar or extension injection, adware, or any tracking manipulation; (d) generate or inflate clicks, sign-ups, or purchases with bots, fake accounts, stolen payments, incentivized or purchased traffic, or fake engagement; (e) offer rebates, cash back, gift cards, commission sharing, or other incentives for purchases; publish discount or coupon codes we did not issue; or list CardPlan on coupon or deal-aggregation sites; (f) use misleading scarcity or deadlines, or describe the offer as limited or ending unless we confirm it; (g) send unsolicited bulk email, SMS, calls, or automated direct messages, or spam communities, or use purchased lists; (h) collect passwords, bank credentials, card numbers, or other sensitive information on our behalf, or use customer or referral information from the Program for anything other than attribution and your own lawful, disclosed practices; (i) create sub-affiliate networks or let others use your Affiliate Links without our approval. You are responsible for anyone who acts for you, including editors and contractors.
7. Brand and Content
7.1 Brand license. We grant you a limited, revocable, non-exclusive, non-transferable license to use CardPlan’s names, logos, and approved assets only to promote CardPlan under this Agreement. We keep all rights in them. Do not alter them in misleading ways or combine them with other branding. Follow reasonable brand instructions and stop unauthorized use on request.
7.2 Your content. You own the content you create. You give us a non-exclusive, worldwide, royalty-free license to link to, embed, and reshare your publicly posted promotional content on CardPlan’s own channels with attribution and without editing it, for as long as it remains public. We will remove our reuse within a reasonable time after you ask. This license does not cover paid advertising, whitelisting, Spark Ads or partnership ads, editing, or use of your likeness in unrelated campaigns. Those require a separate written agreement.
7.3 Third-party rights. You are responsible for permissions for music, footage, images, likenesses, and other third-party material in your content. Platform music libraries may not allow commercial reuse; do not suggest we have rights we do not.
8. Review, Correction, and Takedown
We may ask for links or copies of your promotional content to review compliance. If we reasonably tell you content is materially misleading, unlawful, infringing, impersonating, or inconsistent with this Agreement, you must correct or remove it promptly, and immediately where practical for urgent legal, security, impersonation, or consumer-harm concerns. We may suspend tracking or participation while we investigate. Our review, approval, or silence does not shift responsibility to us or waive any requirement.
9. Fraud and Investigations
We may investigate suspicious traffic, conversion patterns, duplicate accounts, chargebacks, tracking anomalies, and credible complaints. You must reasonably cooperate and preserve relevant records. If we establish fraud, deliberate manipulation, or material breach, we may cancel affected commissions, recover amounts paid, end your participation, and pursue other remedies. We will not cancel unrelated, legitimately earned commissions because of an unrelated dispute.
10. Privacy
10.1 Your information. We collect and use your Program information (such as contact, payout, tax, and channel details) for program enrollment, identity and eligibility verification, attribution, commission administration, fraud prevention, tax compliance and related purposes. We use service providers, including PromoteKit and payment processors, for these purposes. Our published Privacy Policy provides further information about personal-data practices, which may be updated to expressly identify affiliate applicant data before enrollment opens.
10.2 Customer information. We do not give affiliates customer personal data. You must not request it from customers on our behalf. If you suspect a security incident involving Program-related information, notify us within 48 hours of discovery.
11. Changes to the Program and this Agreement
11.1 Program changes. We may change or end campaigns, commission rates, eligible offers, attribution rules, payout methods, and other commercial terms. We will generally give at least 14 days’ notice of changes that reduce compensation or eligibility, except where a shorter period is needed for fraud, security, legal, or vendor reasons.
11.2 Prospective only. Changes to rates, attribution, or eligibility apply to referral clicks occurring after the change takes effect. They do not reduce commissions already earned or approved, or those on purchases attributed to clicks before the effective date.
11.3 Agreement updates. We may update this Agreement by posting it and giving notice through the affiliate portal or your account email. We may require renewed affirmative acceptance before you generate new referrals under the updated version. If you do not agree, you may stop participating before the update takes effect; your continued use of Affiliate Links after the effective date is acceptance where law allows.
12. Term and Termination
12.1 Either party may end participation at any time by written notice. We may suspend or end it immediately for suspected serious fraud, materially misleading advertising, impersonation, security or legal risk, sanctions concerns, or other substantial violations.
12.2 On termination you must stop identifying yourself as a current CardPlan affiliate and stop using our marks, and we may disable your links.
12.3 Valid referral clicks made before a termination without cause remain eligible within their attribution window, subject to the Qualified Purchase requirements. After termination for fraud or material breach, commissions tied to the misconduct may be cancelled or recovered. Accrued, approved, undisputed commissions are paid under Section 4.
13. Warranties and Indemnity
13.1 Your promises. You represent that you have authority to enter this Agreement; your promotion will comply with law and this Agreement; your factual claims will be truthful and substantiated; your content will not knowingly infringe others’ rights; and you will make required disclosures.
13.2 Indemnity. To the extent permitted by law, you will defend and indemnify In Flow LLC, its members, managers, officers, employees, and affiliates against third-party claims, and resulting reasonable losses and attorneys’ fees, to the extent arising from: your false, misleading, unlawful, or unauthorized advertising; your infringement of third-party rights; your unauthorized collection or use of personal information; your fraud, willful misconduct, or material breach; or the acts of those acting for you. This does not apply to the extent a claim results from our own unlawful conduct, negligence, willful misconduct, or CardPlan-supplied materials used as supplied.
13.3 Process. We will give you prompt notice (delay excuses you only to the extent you are actually prejudiced). You may control the defense with qualified counsel, but you may not settle in a way that admits wrongdoing by us, imposes non-monetary obligations on us, or does not fully release us without our consent, not to be unreasonably withheld. We may participate with our own counsel at our own cost.
14. Disclaimers and Limits of Liability
14.1 The Program, dashboard, and tracking are provided “as available.” We make no warranty of earnings, traffic, conversions, or uninterrupted service. This does not reduce any payment obligation expressly stated in Section 4.
14.2 To the fullest extent the law allows, neither party is liable to the other for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, arising from the Program.
14.3 To the fullest extent the law allows, CardPlan’s total liability under this Agreement is limited to the greater of (a) the commissions paid or payable to you in the 12 months before the claim arose and (b) $100. This does not limit our obligation to pay approved commissions.
14.4 These limits do not apply to fraud, willful misconduct, or any liability that cannot lawfully be limited, and they do not limit your indemnity obligations.
15. Confidentiality
Keep non-public CardPlan information (such as unreleased campaigns, pricing, and business data) confidential and use it only for the Program. This excludes information that is public, independently developed, or lawfully received from others. You may disclose it where legally required, and nothing here restricts reports to regulators or any right that law protects.
16. Governing Law and Disputes
16.1 California law governs this Agreement, without regard to conflict-of-laws rules.
16.2 Before filing a claim, a party will give written notice and 30 days to try to resolve the dispute, unless urgent relief is needed or a deadline would expire.
16.3 Any lawsuit will be brought exclusively in the state or federal courts located in Santa Clara County, California, and each party consents to personal jurisdiction there. Nothing here limits non-waivable statutory rights or access to government agencies.
16.4 Customer terms are separate. This Agreement does not include arbitration or a class-action waiver. Those provisions, if any, in CardPlan’s customer Terms of Service apply only to your use of CardPlan as a customer and are not changed by this Agreement.
17. Relationship to CardPlan’s Other Terms
CardPlan’s Terms of Service, Privacy Policy, Lifetime Deal Terms, and Lifetime Feature Schedule, as published at getcardplan.com, govern customers’ purchases and use of the service. They give you no commission rights, and in any conflict about customer purchases or product features, they control the customer relationship.
17A. PromoteKit
In Flow LLC d/b/a CardPlan is solely responsible for operating the Program and determining, approving, and paying commissions owed under this Agreement. PromoteKit provides affiliate-program software and is not a party to this Agreement or the underlying affiliate relationship. PromoteKit does not owe, guarantee, or insure affiliate commissions and has no liability to Affiliate for commission eligibility, referral tracking, attribution, approvals, or payouts, except for any limited obligation expressly undertaken by PromoteKit under separate PromoteKit Payout Terms if its payout service is used. Affiliate will direct questions and disputes concerning commissions and Program obligations to CardPlan. PromoteKit is an intended third-party beneficiary of the statements and protections in this Section 17A and may enforce them directly to the extent permitted by law. This does not eliminate obligations PromoteKit separately owes Affiliate under its own applicable terms.
18. General
18.1 Entire agreement. This Agreement, any campaign rules we give you, and any signed Creator Content Addendum are the whole agreement for the Program. A signed addendum controls over this Agreement for the content rights it expressly covers. 18.2 Notices. We may notify you through the affiliate portal or your account email. Legal notices to us must be sent by email to In Flow LLC d/b/a CardPlan at legal@getcardplan.com. Notices to affiliates may be sent to the email address registered with the Program. Email notices are effective upon transmission unless the sender receives an automated delivery-failure notice. 18.3 Assignment. You may not assign this Agreement without our consent. We may assign it in a merger, reorganization, or sale of the business. 18.4 Severability; no waiver. If a provision is unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver. 18.5 Electronic records. The parties consent to electronic signatures, notices, and records. 18.6 Survival. Sections on accrued commissions, reversals and recovery, warranties, indemnity, liability limits, confidentiality, dispute resolution, and anything intended to survive, survive termination. 18.7 Third parties. There are no third-party beneficiaries except the indemnified parties expressly identified in Section 13 and PromoteKit solely with respect to Section 17A. 18.8 Force majeure. Neither party is liable for delays beyond its reasonable control; this does not excuse paying approved commissions when payment is possible.
